When creating a Time Tracking Policy and selecting Use Standard U.S rules, Lattice accounts for the Fair Labour Standards Act (FLSA) rules as well as some state-specific rules.
Standard U.S. rules are based on the Fair Labor Standards Act (FLSA) under which employees must receive overtime pay (at 1.5x the regular rate of pay) if they work more than 40 hours in a workweek.
For overtime rules applicable to additional jurisdictions beyond what is listed below, you will need to create custom rules:
State | Rule |
Alaska | Overtime pay for time worked in excess of 8 hours in a single workday. |
California | Overtime pay for time worked in excess of 8 hours in a single workday. Double overtime pay (2x regular rate of pay) for time worked in excess of 12 hours in a single workday. Overtime pay for the first 8 hours worked and double overtime pay for time in excess of 8 hours worked on the 7th consecutive workday. |
Colorado | Overtime pay for time worked in excess of 12 hours in a single workday or time worked in excess of 12 consecutive hours. |
Kentucky | Overtime pay for any time worked on the 7th consecutive day of the workweek, if hours worked during the workweek exceed 40. |
Nevada | Overtime pay for time worked in excess of 8 hours in a single workday, if the employee earns less than 1.5x the minimum wage (<$18 per hour). |
